The Gazette and Daily, York, ftPORTS Saturday Morning, May 14, 1966 13 TODAY'S SP0RTSMINU Judge Refuses To Stay Order That Braves Team Return To Milwaukee Central Defeats Eastern In Track Two legal alternatives appeared open to the defense on the basis of vesterdav's action: Milwaukee Iff) The legal battle over the Braves heated up again yesterday as Judge Elmer Roller refused to stay his order that the club return from Atlanta by next Wednesday unless Milwaukee is assured it will have an expansion team next year. The circuit judge upheld the contention of state attorneys that Wisconsin would suffer economic losses up to $18 million a year by the loss of the Braves. Roller ruled last month mat the National League must produce its 1967 expansion plan induding a team for Milwaukee by noon May 16 or return the club May 18. The. Braves have said it would be impossible to uproot from Atlanta.

Two attorneys for the Braves, Ray T. McCann of Milwaukee ana Jinkinson of Chicago, and three for the state, Robert Russell, Steven Keane and John Eppel, met with Judge Roller in his chambers yesterday afternoon for about 40 minutes. Judge Roller said it was agreed at the meeting that if any comment was to be made on the discussion it would have to come from the at tornevs and not the judge. None or. York host to league-leading Lancaster Tuesday. The York High Bearcats, behind the strong six-hit pitching of righthander Mike Hill, toppled John Harris, 5 to 3, yesterday at Small Athletic field in an important Central Penn Scholastic Baseball league clash. The defeat dealt a severe blow to John Harris' title aspirations, as the Pioneers suffered their fourth loss against eight victories, leaving them 2 games back of pacesetting Lancaster (10-1). York High brought its league log to 6-4 and is scheduled to play host to Lancaster in another key game Tuesday afternoon. Hill, who struck out four and walked none, gave up single runs in the second, fourth and seventh innings.

The Bearcats broke in front with a first-inning run as Greg Tome singled, advanced to second on a balk, sto'e third and scored on Wayne Boyce's single the first of his three hits for the day. John Harris tied the score quickly in the second inning when Milt Reis-ser belted a solo homer to left-center field. York took a 3-1 lead with two markers in the third inning. Dennis Stock singled, Terry Kottmyer reached base on an error and Stock tallied on another error. Bill Patterson's single plated Kottmyer with the second run of the frame.

In the fourth, singles by Alan Barr and Bob Barbush plus Dave Snyder's sacrifice fly cut the Pioneers' deficit to 3-2 but York got the run back in the bottom of the inning when Boyce doubled home Stock, who had singled. Tome hit a home run to left-center field in the sixth to boost York High's lead to 5-2. In was his third homer of the season. The judge, in effect, overruled the defense contention that Wisconsin wouM suffer little or no damage pending an appeal to the Wisconsin Supreme Court. "The damage which the public would sustain if the judgment be stayed is incalculab'e," Roller said. Wisconsin vigorously opposed the stay on the ground that it involved damages of $10 million to $18 million.

On the basis of precedents, Roller said, the stay was not called for. He noted that under ordinary circ*mstances the appeal could be heard by the state supreme court in September, but that if it could be heard earlier he would give further consideration to a stay. During the trial, the state had pointed out that Wisconsin's high court might hear the appeal as early as June on an emergency basis.
